Navajo Nation Council votes to waive Colorado River water rights 'Forever'
WINDOW ROCK, NAVAJO NATION — On Thursday November 4th, 2010 the outgoing Navajo Nation Council Voted 51-24 to waive Diné Water Rights to the lower Colorado River ‘Forever’. 70 people marched to the council chambers and joined others in prayer to demonstrate concerns with the proposed Northeastern Arizona Water Settlement. Concerned Citizens for Diné Water Rights affirmed their commitment to stop the settlement.

Statement by Ron Milford of Concerned Citizens for Diné Water Rights, “First of all, I want to thank all the people who planned, coordinated, marched, and provided support for our people’s water rights. I also want to thank the many supporters who couldn’t make it for lack of time, gas money, and other valid reasons. We completely understand. This truly was a grassroots movement of individuals and coalitions, uniting for a common cause–the water rights of our children and future generations.
I also want to give a heartfelt thank you to the twenty-four delegates who stood their ground despite the odds, which was very, very evident yesterday at the council chamber. We will need them in our fight ahead.
Finally, I want everyone to know this is absolutely not the end. There are other options we must pursue to try and stop this settlement. The Nation Nation is a three-branch government, and the legislative council is only a third of the triangle. We now need to concentrate all our efforts on the executive office and the courts. There is also the new council of twenty-four, that I understand can recall this legislation, particularly if new persuasive evidence is presented. My hope also is the new President and VP will open speak against the settlement in support of the 24. Everyone, hang your heads high. We were admirable, and no one can take that away from us. I read the document and have had numerous concerns about certain language and terms of the Agreement. It is wrong to connect he need for waterlines with any irreversible waiver of our water rights. There is no funding for these proposed pipelines. Yet we just agreed to give away our water to all the coyotes who have been stealing it from our people and Nation for years. As far as I’m concerned all the waters that flow off and within the Four Sacred Mountains is ours. We should never shortchange our future generations by leaving them no tools for survival. I further disagree with approving an agreement that will change after it leaves our chambers to conform to AZ State Legislation and then again to conform to Congressional legislation. I thank the 23 other delegates who voted no on a document that was written by and for non-Navajo interests.”

They were murdered wholesale, their land stolen and they now are put into concentration camps politely called "reservations". I wonder how many concrete foundations/mounts must be poured over the 6000 acress in order to achieve 1550 megawatts at high noon on a cloudless day. If It doesn't pan out as planned, then we rip out the 28,000 panels in the future and we're left with thousands of concrete mounts in the ground (imagine an abandoned run-down parking lot). OR, probably less than an acre to punch a hole in the ground and suck out the oil and gas. Ah, but no oil and gas exists there you say. Maybe, maybe not, but it does exist somewhere, so go get it. BUT, that means more CO into the environment. Get over the CO issue, 2 billion plus Chinese and Indians want a Toyota, and they are spewing CO left and right in order to spew more from that new Toyota they plan on buying.
The alternative energy projects and their backers are pathetic. Was this what Van Jones was talking about when he said "Give them back their land"? I am sorry for the Indian tribe and I hope they will prevail in stopping this multinational corporation from building on their land.
I do love the irony of knowing that one of the reasons given for stopping the project is a species of lizard being endangered. Nothing like a bunch of green libs being halted by the same type of arguments that they have used for years to stop people from using their own land.
Imperial Valley is one and the other is the Calico Solar project, which along with the Imperial Valley will produce about 1,550 megawatts of clean, renewable energy annually."
What? This doesn't make sense. It's like saying "I run far because I run 10 miles per hour every day." The megawatt is NOT a unit of energy, it is a unit of power. The energy produced should be given in units of megawatt-hours. The measurement should be megawatt-hours.
The 1550 megawatts power number is when the sun is shining in the middle of a summer day. Take into account nights, low morning, evening and winter sun angles and short winter days and you are down to 25% of that. This is percentage is called Capacity Factor, everyone in the business knows what it is, yet they prefer the summer-midday-sun figure since most listeners will be fooled since they are not technical power people and don't understand the difference. This is deliberate fraud. Oh and by the way, solar power needs water to produce electric, so there goes their water supply! Nothing is sacred!
If they would speak in megawatt-hours produced they would not be able to lie so easily.
This is nothing but a land grab by the Federal Government. The Feds are buying this land and a lot of other land that hasn't come to our attention yet. Then they make it into recreation areas for the public The wind mills are just a diversion. This is so typical of the progressives. They won't show respect for the American Indian but they will bow down to American Muslims...we still have more work to do to vote the rest of the progressives out! Rome wasn't built in a day. And the Socialist's, Marxist's, and Communist's, excuse me! Progressive's have been quietly digging in since 1900. They won't go down without a fight!
(Are they going to dismantel the solar panels at the largest solar farm failure in Europe located in France and set them up on Indian land? and get paid for it?)
Solar panels belong on buildings, not hundreds of miles from the usage. This causes no environmental problems or profits for PG&E or Edison Co, there in lies the problem. Most property owners in the south west, can produce their own power and bypass a middleman that is Gov. controled [PUC] or taxed, fined, fees, and litigated, which must be paid by the consumer. This has more to do with Gov. taxes, and other extortion than it does "green" or shovel ready. There are questions that true environmentalists should be asking that are more important than a lizard.
I have so many problems with this issue I don't know where to begin, but I'll try.
Native Americans have little to hang on to beyond their heritage and faith, living mostly on land nobody thought would have any value...but then oil, coal, uranium, and lets not forget the gemstones and artifacts among this worthless barren land is found, then a place to put solar panels...or uranium deposits...whatever.
So, we take some of it back through government action. I don't like lawyers, but in this case any legal obstacles that can be thrown in front of this wasteful, thoughtless project I will applaud!
Secondly, since when do we talk about creating American jobs and then contract with a foreign firm to do taxpayer funded projects. Obama is so full of it!
Third, I gag when I see all of those stupid "windmills" ruining our beautiful foothills and valleys in California. Doesn't anyone else find those things offensive? I'd rather have deep water oil rigs off the coast than those panels and windmills all over our landscape. What the heck?
Fourth, the Native Americans shouldn't have to make the argument about their religious faith being compromised by the government's actions...just look at what it has done for Christians. Seems religion is getting to be not a viable reason! If it's not Alla they seem to think it's not a religion.
As for the archeological sites and wildlife habitats, specifically that of the flat-tailed horned lizard, which has a part in the tribe’s religious creation stories. They cared not for the Navajo's archeological sites and wildlife habitat, as they ripped up and destroyed hyrogliphic's and ancient graveyards, sacred plants that are no linger in existence. And
I also have serious issues about relocating 12,000 Tribesmen off their lands so that coal and yellowcake could be extracted, leaving them to face hardships .
Tribal peoples of America are independent nations with whom we have treaties. Technically they would have no claim on tax dollars except where individuals have acquired Social Security numbers and paid into this scheme plan. Independent nations cannot sue in our courts without express permission of state or federal government. Since a foreign company is also involved, it is obviously a "stimulus" to the foreign country in which they are incorporated - not America.

Exactly. The FBI is allowed for things like murder. The UN is who we go to for most everything else.
Why would they want to put them in the desert anyway? Solar panels belong on the facilities using the energy produced by them. I support the Quechan on this one.

Solar fields are very water intensive. Where are they going to get the water, there is little left in the Colorado River for that area! Also, if they do built the solar field the water usage would deplete the Tribes own water supply as what happened on the Hopi Reservation here in Arizona. The Hopi eventually terminated their long contract with Peabody Coal so that their springs would flow again. The Hopi have strict tribal laws against casino's on sacred lands, they invest in real estate in Northern Arizona for tribal income.

Don't be fooled by the 1550 megawatt number from Tessera, the project owner. That number is when the sun is shining on a hot summer day. Take into account nights, low sun angles in morning, evenings and winter, and short winter days, and the real number is one quarter of that.
Having been a party to the Energy Commission hearings, Tessera's claim of 'lengthy and thorough conversations with Native Americans and other interested parties' is fiction.
The project, like other fast-track desert solar projects, will get free government money to get it started, then the government will take all risk by providing a loan guarantee from the Department of Energy. Electricity rates paid to Tessera are secret - Tessera says their contract prohibits disclosure. The result: Public money, credit and land are being used for a project not US owned, and we don't even get to know how much electricity will cost.

Another costly, make-work, feel-good, high-maintenance "green" project. Solar generates very little power for the investment, it requires constant upkeep, and the panels have to be replaced every so often. Check out the solar power array in Andalusia, Spain - they have 24/7 crews going around replacing malfunctioning panels, drive motors, etc. No doubt costs a nice pile of Euros for that maintenance, and that cost is no doubt passed on to the end users.

This post proves a point I have long made: that Democratic Congressmen are willing to collude with marxists in order to promote socialist legislation and to influence the political direction of the United States.
This is how the modern Democratic Party actually works - in partnership (often junior partnership, at that) with hard core marxists.
Rep. John Conyers, Jr. (D MI), chair of the powerful House Judiciary Committee has been caught on tape, meeting with members of the U.S.'s largest marxist organization Democratic Socialists of America.
The tape clearly shows Conyers treating the marxists as friends. He continually refers to the gathering as "we", as he urges the comrades to rally behind his "beloved 44th president", Barack Obama.
The tape, posted on the D.S.A. Vimeo site, was filmed before the recent One Nation Rally in Washington DC, and shows Conyers speaking to a meeting of D.S.A. members in what appears to be an hotel room.
The website clearly states that this is a D.S.A. meeting and Conyers is introduced to the gathering by D.S.A. National director Frank Llewellyn. Prominent Boston D.S.A. member David Duhalde appears on the right, behind Llewellyn, wearing a beard, black T shirt and a cap.
In the first few seconds, Conyers is introduced by Frank Llewellyn as the "only congressman endorsed by Martin Luther King".
Llewellyn then notes Conyers' "long support for HR 676, the single payer Bill that this organization [D.S.A.] has long supported".
D.S.A. has indeed "long supported HR 676", which sprang from the "single payer" health care movement midwived by Chicago physician and D.S.A. member Quentin Young - a close personal friend of both John Conyers and President Barack Obama.
At about 34 seconds Llewellyn states, "many might not know that John is in the process of introducing sweeping legislation to address the jobs crisis - which is certainly one of the most important crises we face and one of the reasons why we're all here today."
At 60 seconds Conyers starts talking, addressing Frank Llewellyn by name and then says,
"Its good to know that a lot of my Michigan and Detroit and Grosse Point people are here. David Green, and Dave and Herman and probably others."
David Green is a leader of both Michigan and national D.S.A. Green visited Cuba in 2009 and proved his marxism with this statement in the Spring 2007 issue of D.S.A.'s Democratic Left.
"What distinguishes socialists from other progressives is the theory of surplus value. According to Marx, the secret of surplus value is that workers are a source of more value than they receive in wages. The capitalist is able to capture surplus value through his ownership of the means of production, his right to purchase labor as a commodity, his control over the production process, and his ownership of the final product. Surplus value is the measure of capital’s exploitation of labor
Our goal as socialists is to abolish private ownership of the means of production. Our immediate task is to limit the capitalist class’s prerogatives in the workplace...
In the short run we must at least minimize the degree of exploitation of workers by capitalists. We can accomplish this by promoting full employment policies, passing local living wage laws, but most of all by increasing the union movement’s power...
The Employee Free Choice Act (EFCA) provides an excellent organizing tool (i.e., tactic) through which we can pursue our socialist strategy while simultaneously engaging the broader electorate on an issue of economic populism.
This is one of John Conyers' "people". Coincidentally Conyers is also a big fan of the EFCA.
After a "new agey" rave about the "oneness" of everything (cut out of this video), Conyers thanks the gathering for coming to the march and at 1:30 minutes goes on to say:
"This is an important event, that we don't doubt will be played down and misinterpreted by the corporate media...We understand the significance of it. We know that when unions, political ideology, clergy, labor, civil rights come together... and just people that are progressive enough to see in this one World concept, that we're all in this together, it makes certain things easy to understand where we're coming from."
At 2:25 minutes, Conyers talks about "peace" and Dennis Kucinich.
"Overriding it all is the quest for peace in the world...and I am firmly supporting Congressman Dennis Kucinich's measure that would make a Department of Peace in the United States Federal government." (applause)
John Conyers was once an affiliate of the Soviet front World Peace Council. Like Kucinich, Conyers also has a long history with the Communist Party USA, which has consistently advocated such measures.
At 4:20 minutes, Conyers moves on to the "question of my beloved 44th president of the United States."
Conyers criticizes America's war in Afghanistan and how "we" need to "make it clear to him, through all the usual means of communication, including pickets and protests....there probably isn't anybody above the 10th grade who doesnt know that you cannot win a war in Afghanistan." (laughter).
At 7:35 minutes Conyers says of Obama;
"I respect him, I support him... I say that all against the backdrop, of the fact that in 2012, there is a highly organized effort to make sure that he is a one term president.
This started even before he was sworn in. It's grown... I only mention the Tea Party, because it is small and dismissible, but there are much more serious and affluent sources behind this effort to interfere with a re-election campaign of Obama... I've got to ensure he is re-elected 2 years from now. That calls for some balancing, but not a whole lot from where I stand."
At 6.10 minutes Conyers goes on to deal with how those assembled need to help Obama.
"I see that us making him more cooperative with our plans is going to strengthen him and not weaken him... (applause) And to have this press secretary of his denouncing the left is an automatically dismissible act, if I were president...
The whole point is that, trashing progressives and the left, and at the same time watching your ratings go down - gee... what's so difficult about figuring that out?... Whose job do you think it is to get him straightened out and get him on the right track? Ours! Ours!" (applause)
D.S.A. has tried to publicly distance itself from Obama in recent times, though they have a twenty seven year history with the President. Even Conyers has publicly criticized the President.
Clearly, John Conyers understands he is among friends, who are just as pro-Obama as he is. In private, Conyers and D.S.A. are right behind their man.
Like Obama, John Conyers has a long history with D.S.A.
John Conyers was a special guest on day one of the Democratic Socialist Organizing Committee/New American Movement Unity Convention in Detroit March 21/22 1982, that resulted in the formation of D.S.A.
In 2003 John Conyers was a keynote speaker at the D.S.A. national conference in Detroit - with 2008 Obama Black Advisory Council member Cornel West and the first journalist to promote obama on the national stage, the Washington Post's Harold Meyerson.
In 2005 D.S.A'.s Democratic Left -Spring edition, called "Congressman John Conyers (a key D.S.A. ally in Congress)..."

The real secret of contemporary U.S. Politics is this:
Under today's Democratic Party, much of the legislation they push for is not made by Democrats. It is actually formulated by organizations close to D.S.A. and the Communist Party. It is then infiltrated into Congress by socialist sympathizers like John Conyers and his comrades, in the more than eighty strong, D.S.A. co-founded Congressional Progressive Caucus.
Socialized health care, the grossly mis-named Employee Free Choice Act, the current push to "normalize" relations with Cuba, even the campaign for a national holiday in honor of D.S.A. and the Communist Party's best friend Cesar Chavez, are all communist/socialist initiatives.
If this sounds far fetched, remember that in most U.S. states the Democratic Party is almost totally dependent on labor unions for manpower and money.
Since D.S.A. member John Sweeney became president of the AFL-CIO in 1995, the once anti-communist U.S. labor movement has come under near complete marxist control.

Think of it this way. Just as the Mafia once used "respectable" front-men to control Las Vegas casinos, the marxists use "respectable" Democrats, kept in line with labor union "muscle" to control your Houses of Congress.
That's how it works America.
If you don't start throwing the Democrats out of office come November, your children may inherit a country permanently ruled by these people.

Public Testimony of Traditional and Marginalized Lakota to Expose Graft, Bias and Corruption in BIA Tribal Government Practices
PINE RIDGE, S. D. – If the U.S. Department of Justice (DOJ) keeps their word, members of the Oglala Lakota of the Pine Ridge Reservation in South Dakota may be facing a historic meeting with the U.S. Government.
The DOJ promise to meet with the “poor people”, full-blooded Lakota and traditional people was sparked by the unexpected take over of the June 18th Section 611 Consultation in Rapid City, S.D., between United States officials and members of the U.S. created Oglala Lakota Government by the Lakota warrior society known as Cante Tenza (Strong Heart).
Cante Tenza took over the meeting on behalf of many Lakota who have watched for decades while the Bureau of Indian Affairs (BIA) supported Oglala Tribal Government has squandered or stolen millions of dollars in U.S. support while alienating and even attacking full-blooded and traditional Lakota and the traditional Lakota systems of governance.
“The officials in tribal government don’t speak for the people, they don’t know how,” explained Cante Tenza headsman Canupa Gluha Mani (Duane Martin Sr.) who helped lead the June 18th take over. “This consultation is with a tribal government that people don’t trust, making systems that don’t even speak our language.”
While tribal council officials objected to the interruption and left the building, traditional warrior society members continued meeting with U.S. government agencies and secured a promise in writing that the Justice Department would visit Pine Ridge to meet with Lakota who have faced economic, social and physical attack by corrupt BIA governments for decades.
In a letter sent to Leslie Hagan, Native American Issues Coordinator for the United States Attorneys of the Department of Justice, Canupa Gluha Mani (Duane Martin Sr.) repeated the cause for the meeting, “It is long overdue for the Department of Justice and FBI to stop supporting the destruction of the Lakota people and our sacred way of life, and instead face-up to its continued support of an illegal and corrupt tribal government whose actions perpetuate injustice, misery and death in our nation. ”
Few people outside of Pine Ridge understand the history of the illegal tribal government that was imposed on the Oglala Lakota and its support of U.S. Government efforts to force assimilation and attack traditional and full-blooded people by keeping them away from their own language and culture. The famous 1973 takeover of Wounded Knee by native activists and Oglala tribal members was a reaction to this forced assimilation that continues today.
“This meeting is one step in healing these injustices and returning freedom and sovereignty to our noble people. Its time we step up to the pedestal and express our credibility,” Martin said.

I cannot understand the Government; Obama has been offering all kinds of things to all the Nations, giving back to a sense, for everything bad that has happened to us from the time the white man set foot on American soil. Offering us more law enforcement; medical; clean up of hazardous waste and an assortment of other offerings...all the while stealing land; mineral resource's; water rights, our right's to anything important to our survivial on what's left of our lands after the BIA and McCain and all his buddies destroyed it. Since 1944 The Government & the BIA has had a hand in ripping the Indian Nation's very existance from Mother Earth! We are human beings! Can't you get this through your head's? We've always been this.....All we are trying to do is peacefully live our live's on what little land you crowded us onto back in the 1800's/1900's! Little did all of us, both the Nation's and the Government know that we were sitting on a virtual gold mine of coal and yellow cake. Once the Government found this out, they have destroyed us in every way imaginable! We go to the UN for help and they do nothing! We take it to the Supreme Court and are ruled against...even when they side with us; The Government goes on with what they were doing and everyone turns and looks the other way.It puts me in such a rage! It sickens me! Where is the people out there that can help the NDN Nations and why won't they step forward and help us?

The water rights settlement being proffered by bureaucrats, certain politicians, and longtime water attorney Stanley Pollack has been recently discussed at chapters of Western Navajo asking for their consent to the agreement.
The settlement, a fraction of the aboriginal claim of the Dine’, has been represented as the “best offer we could get." The question becomes who is it best for?
Once the Dine’ had great leaders like Manuelito and Barboncito, who defined Dine’ bi Keyah by 4 rivers and 4 mountains; these leaders understood negotiations; they had fought off the most powerful empire in history by skillfully playing faction against faction.
These leaders understood they must fight for the protection of the homeland and still leave a great legacy for the coming generations. Skillful leaders afterwards grew the Nation to its’ present size. Almost 100 years later a brave chairman asserted the same claim, calling out the empire for its’ illegal overthrowing of our Nation, and demanded that our compensation equal what is our birthright.

After the removal of former Navajo Chairman Peter MacDonald, it was interesting to see where the attorneys went, who were involved in his removal. One of those attorneys were to DC and worked in water rights, and the others went to southern Arizona to "negotiate" Indian Nations water rights settlements with the federal government.
Earlier, during the federal trial of MacDonald, a Navajo businessman told me the bottom line of the imprisonment of Peter MacDonald. He said, "This about water rights."

initiated on the part of Congress,” said MacDonald.
MacDonald said Congress began urging Indian tribes in 1989 to agree to water settlements with states in order to bypass the Winters Doctrine.
"It was done to quiet all the water rights questions in the West,” MacDonald said.
"The carrot” being held out to Indian tribes, he said, is the promise of federal money to develop water on Indian lands.

The US Environmental Protection Agency has entered into two enforcement actions, both of which will result in the cleaning up of uranium contamination on the Navajo Nation and Hopi reservations, according to a press release issued by the EPA on Sept. 13.
In one settlement, Rio Algom Mining LLC, a subsidiary of Canadian corporation BHP Billiton, has agreed to control releases of radium (a decay product of uranium) from the Quivira Mine Site, near Gallup, N.M. The company will also conduct a comprehensive investigation of the levels of contamination at the site.
Under the second settlement, the U.S. Department of Interior's Bureau of Indian Affairs will begin a comprehensive investigation of the levels of uranium and other contaminants in the waste, soils and groundwater at a landfill in Tuba City. It will also evaluate the feasibility of a range of cleanup actions.
From 1944 to 1986, millions of tons of uranium ore were mined from these lands. While the mines are now closed, the contamination from some 500 of them remains, as do homes built with contaminated mine waste and contaminated water wells. Potential health effects from this contamination include lung cancer, bone cancer and impaired kidney function.
In January 2008, the House Committee on Oversight and Government Reform directed five federal agencies (Environmental Protection Agency, Bureau of Indian Affairs, Department of Energy, Indian Health Services and Nuclear Regulatory Commission) to work together to address this problem. They developed a five-year plan to address contaminated homes, wells, mine sites, mills and dumps. The recently announced cleanup efforts are part of this plan.
The coordinated plan has already resulted in the replacement of 14 homes, the assessment of more than 200 mines and funding for water systems that will serve over 3,000 people with clean water, Jared Blumenfeld, Regional Administrator for EPA's Pacific Southwest Region, said in the release.

SELLS, Ariz. – The Tohono O’odham Nation and Arizona’s intertribal council have passed resolutions against S.B. 1070 – an anti-immigration state law that has unleashed a storm of protest from opponents who say it is a racist call to discriminate against people of color.
The Tohono O’odham Legislative Council passed a resolution May 19 opposing S.B. 1070 as “discriminatory state legislation” and supporting “lawful measures to repeal or invalidate” it.
Tohono O’odham Chairman Ned Norris Jr. presented the resolution to the Inter Tribal Council of Arizona. On June 4, the council’s 20 members unanimously approved a separate resolution against the law, council Executive Director John Lewis said. Both resolutions will be brought to the National Congress of American Indians at its mid-year meeting June 20 – 23 in Rapid City, S.D., where the congress will be asked to adopt a resolution opposing S.B. 1070.
S.B. 1070, which was signed into law by Gov. Jan Brewer April 23, makes the failure to carry immigration documents a crime and gives police officers virtually unrestricted power to detain anyone they have a “reasonable suspicion” of being in the country illegally.
Police officers may consider race, color, or national origin to determine “reasonable suspicion” – an open invitation to racial profiling that is highlighted in the O’odham resolution.
“By failing to provide a definition for the ‘reasonable suspicion’ that allows state law enforcement officers to investigate immigrations status, S.B. 1070 encourages racial profiling that will disproportionately affect minority residents with legal immigration status.”
Furthermore, S.B. 1070 will also impact Arizona’s huge Native population, the resolution says.
“Although Native Americans have been present in what is now Arizona since time immemorial, many tribal members speak English as a second language, do not speak English, or were not issued birth certificates and lack documentation establishing their citizenship and lawful residence in the United States, and S.B. 1070 therefore will expose Arizona tribal members to arrest if they are suspected of being illegal aliens and cannot document their citizenship or lawful presence in the United States.”
The problem will be particularly acute on Tohono O’odham land, which is dissected east and west by state Highway 86. Tribal members use the highway and even sometimes hitchhike on it to get into Tucson, and therefore are vulnerable to any state law enforcement officer with a “reasonable suspicion” that those tribal members are illegal, Norris said. The police would have the authority to question and detain tribal members who couldn’t prove their citizenship.
“S.B. 1070 has the potential to create tension between law enforcement and the community not only outside the O’odham nation, but also inside the nation on Highway 86. Our concern is if a segment of the community is afraid to cooperate with the (state) police it’s our view that everyone in the community suffers,” Norris said.
While S.B. 1070 has a provision to acknowledge tribal enrollment cards as allowable identification, the O’odham resolution opposes requiring members to carry proof that they are “lawfully present within their aboriginal homelands.”
Tohono O’odham’s aboriginal territory was huge, covering southwestern lands extending south to Sonora, Mexico, north to central Arizona north of Phoenix, west to the Gulf of California, and east to the San Pedro River.
Even now, the nation has a vast homeland of 2.8 million acres in the U.S, but it is cut off from nine O’odham communities in Sonora by the international U.S.-Mexico border. The nation has an arrangement with the Department of Homeland Security and border patrol agents to acknowledge tribal identification cards to allow members from Mexico to travel north to avail themselves of health and other services the nation offers, a system that works “fairly well,” Norris said.
But it is the thousands of undocumented migrants crossing the 75-mile border onto O’odham land that presents the nation with unique challenges and expenses. S.B. 1070 does nothing to alleviate those problems, Norris said.
“It’s our belief that 1070 fails to address the border security crisis and it fails to address the need for comprehensive immigration reform.”
The O’odham nation spends more than $3 million a year dealing with the flood of illegal migrants coming through its territory, including expenses for border security, death investigations, drug trafficking investigations, trash removal and other services. The rate of migration has at times reached 1,500 people a day and now is around 700 – 800 people a day, Norris said.
O’odham’s law enforcement officers spend up to 60 percent of their time dealing with border security issues, taking away time that should be spent on protecting tribal members over the rest of the nation’s vast territory, Norris said. The nation receives no reimbursement for these expenses.
The solution is comprehensive immigration reform at the federal level, not a state law that will have disastrous consequences for the people and the state of Arizona, Norris said.
“The U.S. government needs to look at its current policies on how it addresses immigration. We believe immigration reform could make it more appropriate for persons, in this case, Mexican citizens, to become U.S. citizens. The process now is so cumbersome and discouraging and it’s not working.”
Norris said the nation also supports measures that would allow migrant workers to come into the country as guest workers. The problems of immigration are separate from the problems related to the crimes of drug trafficking.
“When we look at the migrants, all the migrants want to do is make a living for themselves and be in a position to contribute to the welfare of their own families. We believe if the U.S. reformed how it addresses immigration that would have much more of a positive impact in addressing illegal migrant activities than we currently have to deal with.”
